Curley’s Burning Anger â€Å"Holding onto anger is like grasping a hot coal with the intent of throwing it at someone else; you are the one who gets burned,† Gautama Buddha. Spiritual leader, Buddha, made this statement during his successful lifetime in the 6th century B.C. Curley is a character who deals with anger and making threatening actions. In the novel Of Mice and Men by John Steinbeck, George and Lennie have always dreamed about living with their own far, home, and land. But as Lennie has some sort of mental issues, he doesnt always understand the consequences to his actions. On the ranch, Lennie and George meet Curley and automatically feel threatened by him. The fact that Curley walked into the room very forcefully and demanded to know where is wife is, gives us evidence that Curley can be aggressive towards others. Overall, Curley’s actions go to shows how he can be very unfriendly towards other characters in the book. In the book Of Mice and Men , the character Curley is shown to be physical. A lot of evidence to support this was seen in chapter 3. On page 63 it says â€Å"He slashed at Lennie with his left, and the down his nose with his right. Lennie gave a cry of terror. Blood welled from his nose.† (Steinbeck 63). All of this proves that Curley can be physical because in this scene, he punched Lennie in the face. By the text, the readers can tell Curley hurt Lennie pretty bad. As Lennie had blood all over his face. Also on page 63 it states, â€Å"Lennie covered his face with huge paws and bleated with terror. He cried, â€Å"Make ‘um stop, George.† Then Curley attacked his stomach and cut off his wind.†(Steinbeck 63). This is important because in the scene the readers get to see the real Curley. Here, Cole has acted within the express actual authority when he entered into the cleaning contract with Pristine Clean. Besides, the he had entered into the contract in the best interest of Glasshouse Enterprise as he believed the offer would save the business money. Hence, hence, as per agency relationship between Lena and Cole, where Lena is the Master and Cole is the servant, she is bound by the acts of Cole done within the authority of the employment. Further, since Lena and Rowan are the agents of the Glasshouse Enterprise company, the company being the principal is bound by the actions or omissions of the agents. Rowan and Lena had an implied actual authority to engage in activities that is necessary to perform their duties as was held in Hutchinsons case[10]. Therefore, appointing Cole to obtain cleaning contract for the Glasshouse company to expand the business which amounts to the best interest of the company, falls within their implied actual authority. Under such circumstances, as Rowan and Lena is bound by the conduct of Cole, similarly, Glasshouse Enterprise shall be responsible for the contract entered into with the Pristine Clean and shall pay off the debt of $15,000 that it owes to Pristine Clean under in the context of agency relationship. However, Cole being the servant/employee who is expressly authorized to obtain cleaning contracts on behalf of Glasshouse, cannot bind his master for any of his conduct or omission that is done outside his authority. Here, Cole started a marketing mop which he designed for the customers and retained 95% of sale proceeds that he obtained from selling the mops. Lena Rowan were not aware of the marketing of the mops which clearly establishes that Cole was acting beyond his authority. People, who love the acceptance of divinity, are the sole person who can spread more concepts of Christianity. According to Oborji (2016), Christianity is the purest form of religion, which does not force any individual to be converted. The amount of conflict and disrespect is the lowest in Christianity. Therefore, it can be said that the amount of Christianity conversion will be highest in Christian religion. Investigating the nursing process and nursing care Essay In this essay I will use the nursing process which is an individualised problem-solving approach to nursing care. It involves four stages: assessment (of the patients problems), planning (how to resolve them), implementation (of the plans), and evaluation (of their success). The implementation phase is when you put your care plan into action. Implementation encompasses all nursing interventions directed at solving the patients problems and meeting health care needs. While you co-ordinate implementation, you also seek help from the patient, the patients family, and other members of the health-care team. I referred to the workings of the SMART (Specific, measurable, achievable, realistic and time orientated) principle. The nurse explained to me how important it is to read the patients theatre notes to confirm the surgical procedure, which has been carried out and ascertain any instructions from the surgeon or anaesthetist. I was explained that I will have to ensure that the patient is lying in the most comfortable position possible, and that the limbs are positioned in a manner, which will not endanger muscle and nerve tissue. The nurse told me that the policy was also to allow graduated amounts of fluid unless contra-indicated (e. g. the presence of a naso-gastric tube), then gradually introduce solid food if there is no vomiting and if bowel sounds are present. Also to record the amount and time when the patient passes urine and when the patient has a first bowel movement. The nurse asked me to ensure patient has adequate periods of rest. I was told to carry out these observations by my mentor. Some of these observations such as record blood pressure, pulse, and oxygen saturation and respiration rates should be carried out every fifteen minutes for an hour, then every half hour for four hours, then after that hourly for a certain period of time. The patients observations should be monitored for twenty-four hours closely. This does not always mean carrying out clinical measurement with special equipment although of course this is carried out a great deal. It means, literally, look at your patient frequently, and get used to how they appear and behave when they are stable and comfortable. Because we are then able to notice even the very slightest changes in the patients condition and these observations can be life saving. When Rachel was brought back to the ward from recovery, I came to meet her in her room. I greeted Rachel and asked her how she was feeling, and whether she was nauseous or in any pain. Pain is what the patient says it is, existing when he says it does. (M. McCaffery, Nursing the patient in pain, 1983) I needed to find this out for her post operative chart. Rachel then replied that she wasnt in any pain and not feeling nauseous. I then asked Rachel if she was comfortable or needed anything, Rachel replied that she was fine but feeling a little tired. Individuals are primarily social beings and a major part of living involves communicating with other people in one way or another (Roper et al applying the model in practice 1996). I then went on to assess her level of consciousness and discovered that Rachel was still slightly drowsy which was not abnormal as she had just returned from theatre. I recorded the results clearly and in such a manner that the text can not be erased. I also recognized that I should not include abbreviations, jargon, meaningless phrases, irrelevant speculation and offensive subjective statements. As stated by the NMC (Nursing and Midwifery Council, Guidelines for records and record keeping, London 2005) Then Rachel gave consent for me to conduct her observations I started by taking her blood pressure. Blood pressure is always undertaken on admission so we have a normal range for the individual patient and thereafter if required and according to the patients care plan. This is an important clinical measurement of cardiovascular function and one that denotes critical changes or potential changes in a patients condition. Post operatively, it is important to check and record frequently. Blood pressure is the force extended by the blood as it flows through the blood vessels. It is arterial blood pressure, which is normally recorded. Blood pressure increases with age, weight gain, stress anxiety. Normal range is considered to be from 100/60 to 140/90 mm Hg. The term hypotension is used when the blood pressure is lower than the normal range. The term hypertension is used when the systolic or diastolic blood pressure is elevated above the normal range. In which a small sensor is placed on the patients finger or earlobe, for measuring the proportion of oxygenated haemoglobin (oxyhaemoglobin) in the patients blood. It works by measuring the amount of specific types of light that are absorbed by body tissue. An Alternative term is called an Oxygen Saturation Test. (2000-2006 HealthCentersOnline, Inc. ) Rachels oxygen level in her blood was 98%, which is within her normal range. I recorded this and her blood pressure results on her observation chart. I then informed Rachel that I was about to take her temperature and received her consent. Checking the temperature regularly is very important because an increased temperature maybe a sign that the patient could have an infection, or may have an allergic reaction to the medication she may have been given. Sites for recording body temperature include the axilla, rectum and ear. For each patient, the site for temperature measurement should be consistent. In order to take her temperature I used a Tympanic and inserted the probe into the outer ear, adjacent to but not touching the tympanic membrane. Before I use the Tympanic I had to check a few things to make sure I didnt get an inaccurate reading. Such as wax in the ear, a cracked or dirty lens, and poor fitting in the ear and if the patient has been recently lying on the ear that is used, (Jevon. P, Using a Tympanic thermometer, Nursing Times 2001, 97(9): 43-44) Next I took Rachels respiratory rate, which is thought to be the most sensitive indicatory of a patients physiological well being. This is logical because respiratory rate reflects not only respiratory function as in hypoxia or hypercapnia, but also cardiovascular status as in pulmonary oedema, and metabolic imbalance such as that seen in diabetic ketoacidosis (DKA). Nursing Times. 2001; 97:32-33. ) Respiration is the exchange of oxygen and carbon dioxide between the cells of the body and the environment through rhythmic expansion and deflation of the lungs. Nursing 18(1): 57-63. ) When I assessed Rachels respiration, I had to ensure she was relaxed and unaware of the counting process, I then had to count the respiratory rate and observe the depth and pattern of respiration and count the number of respirations for at least 30 seconds. (Finesilver, C. (1992) Respiratory assessment. RN 55(2): 22-30) I did this by asking Rachel whether I could take her pulse and counted her respirations for 60 seconds. Her respiratory rate was 14. Normal respiratory rates can vary according to age. The accepted normal range for healthy adults is 14 20 per minute. (Torrance, C. and Elley, K. (1997) Practical procedures for nurses. Torrance, C. and Elley,) I recorded the rest of Rachels results on her observation chart and informed the nurse in charge of Rachels care that her observation were in a normal range and showed her the chart just to double check my knowledge of this subject was accurate. The nurse in charge checked the results on the chart and informed me that my decision was correct and her observations were within normal range. In conclusion with the help of nursing models I have used previously. I feel that I have implemented my patients care effectively and efficiently. The Roper, Logan and Tierney model (Roper, N et al 2001) which I used in my patients assessment, helped me break down my patients care to find out what my targets were, in order to treat her care holistically. I then used the SMART principle (Hinchcliff, S, 2004) in the planning of Rachels care. It helped me turn the issues highlighted into more achievable and measurable goals. I feel that if I never used these models then Rachels care would not have been implemented properly.

Litigation is expensive, time-consuming, and incredibly stressful. Most writers don’t have much to worry about. The odds that they’ll end up in a courtroom for something they wrote are fairly low. Our First Amendment right to free speech offers significant protection to write freely. One exception to this rule is the world of memoir.The reason the memoir genre is compelling is because it’s fascinating to read the dirty details of others’ lives. Memoir authors usually don’t write about rainbows and sunshine, they write about the salacious. Abuse, sex, addiction, and family drama- it’s the Sturm und Drang that people want to read about. This is the primary reason why memoirs open the door for lawsuits.There’s a fine balance when you’re writing your memoir. Of course, it’s your story, and as such, you want it to be told without barriers. Yet, you need to consider those you’re writin g about. They may not want to be part of your story. And, in some cases, if you violate the law, they may have the right to retaliate with a lawsuit.We can all agree that there are better things to spend your book royalties on than exorbitant legal fees. Case Study: Running with ScissorsSince we’re discussing legal issues, it seems fitting to start with a case study on the issues of memoir, defamation, and invasion of privacy.Critically acclaimed author Augusten Burroughs published the best-selling memoir, Running with Scissors in 2003. In his book, he recalled his time living with the fictional â€Å"Finches.† His book recounted abuse, drug use, dysfunctional family behavior, living in squalor, an d other unsavory details any family wouldn’t want blasted all over printed pages.Burroughs claimed that while he did change the name of the family (in real life, the Turcottes), the harrowing details of his time spent in their care were true. The Turcottes filed a defamation and invasion of privacy torts suit against Burroughs and his publisher. The family asserted that Burroughs fabricated facts and violated their privacy.Burroughs’ defense hinged on his assertion that the facts, as he wrote them, were true; therefore he had not broken any laws. The parties settled out of court. As part of the settlement, Burroughs changed his acknowledgments to say the Turcottes had â€Å"conflicting memories† of the described events. Burroughs was legally obligated to amend his book acknowledgments to read as follows:I would like to thank the real-life members of the family portrayed in this book for taking me into their home and accepting me as one of their own. I recognize that their memories of the events described in this book are different than my own. They are each fine, decent and hard-working people. The book was not intended to hurt the family. Both my publisher and I regret any unintentional harm resulting from the publishing and marketing of Running With Scissors.2. Understand the ConceptsThe best defense is a good offense. In litigation that means don’t do anything that will get you sued. Before you publish your memoir, it’s important that you understand your rights to free speech, as well as defamation and invasion of privacy issues.First Amendment ProtectionThe First Amendment protects your right to free speech. This protection applies to both the spoken and written word.DefamationIn short, defamation is when you ruin a person’s reputation. Blacks Law Dictionary defines defamation as, â€Å"The taking from one’s reputation. The offense of injuring a persons character, fame, or reputation by false and malicious statements.† The term covers both libel (written) and slander (spoken).Only living people can sue for defamation, so someone can’t file a lawsuit against you for defamation through an estate or relatives.Invasion of PrivacyInvasion of privacy lawsuits hinge on public disclosure of private facts. Private facts are sensitive information that the average person would not want to share with the general public; for example, medical records, adoption records, abuse, alcoholism, etc. Just as with defamation, an invasion of privacy suit can’t be brought by an estate or relatives. Even if what you write is 100% true, someone can still bring an invasion of privacy suit based on public disclosure of private facts.3. Preventing a Defamation Cause of ActionThe best defense against defamation is the truth. Suppose you write that your neighbor was convicted of axe murder. He can’t bring a defamation suit against you if he was, in fact, convicted of axe murder. But if you write, â€Å"my neighbor could be capable of axe murder because he’s crazy,† then you’ve got some defamation issues.Practical Tips to Stay Out of Courtroom:If your facts will not hold up as 100% true in a court of law, you can open yourself up to defamation. Before you write, make sure to check your facts. You want to know that if you’re writing about something controversial, that you’re not fabricating the truth.The second tip to avoid defaming your memoir characters is to frame controversial statements as your opinion. Opinions are (*usually) legally considered â€Å"protected expression.† That said, there are parameters. You can’t simply state that blatantly false statements are opinions and get away it. Writing, â€Å"In my opinion, Sara Smith is a prostitute†- when Sara Smith is an upstanding mom and doctor- will get you in trouble. Your opinion needs to be balanced by evidence and supported by actual fact.The third tip t o avoid defamation issues is to change anyidentifying information about your book characters. In order to prevail in a defamation case, the defamed must prove others are able to identify him from your writing. A caveat: This doesn’t mean by name alone! People can claim defamation if one could reasonably identify them through their actions, clothing, quotes, physical appearance, address, or any number of identifying points.The fourth tip is that defamation rests upon subjective principles. When in doubt, err on the side of caution about disclosing details that may or may not be true. If you can’t defend the truth in a court of law, don’t publish it.The final tip is to print a disclaimer in your preface, intro, or acknowledgements. Simply by stating your memories are imperfect but you’re sharing to the best of knowledge and that you’ve changed identifies can stave off legal woes.4. Avoiding an Invasion of Privacy Cause of ActionJust as with a defamat ion lawsuit, an invasion of privacy lawsuit turns on subjective opinions to be decided on a case-by-case basis. This means that the individual facts of each case will decide the outcome.Common sense dictates that there are certain private facts, which a person would not want shared with the public. If a good friend had given up a child for adoption, and you were the only person she told, then disclosing that in your memoir would open the doors to an invasion of privacy lawsuit. The same would apply to sensitive information such as private health matters, abuse, addiction, or any information would not be readily accessible to the public.Certain public or high profile individuals may have less protection against invasion of privacy. The legal theory is that because they have opened their lives to public scrutiny, then the bar is lower for privacy protection. If unsavory facts can be classified as public interest, then you may be able to disclose certain things about public individuals . The crux of this issue would turn on whether your facts are related to a matter of â€Å"public concern.†Practical Tips to Stay Out of the Courtroom:There are several ways to avoid invasion of privacy lawsuits. Our first tip is to get written permission from your characters. If you obtain written consent, they can’t later file a suit stating you’ve breached their privacy.Our second tip is the same as with defamation: Change all identifying characteristics. Give your characters a different name, different job, different wardrobes- anything you can change to prevent them from being recognized by your words affords you a degree of protection. Some writers like to create an amalgam of characters to mix up identifying facts.Our third tip is tell the truth. Dont lie (or even embellish). It’s unethical at best; at worst, it can get you in legal hot water.Our fourth tip is carefully weigh the impact of disclosing inflammatory, sensitive, or embarrassing informa tion. Are such disclosures essential to your story? If so, tread carefully and use our rules for how to proceed with caution. If you’re on the fence, it’s always wise to run your concerns by a lawyer to head off any issues before you publish. Paying for an hour or two of legal time is far better than being a defendant in a court case.The best memoirs are brazen, open, and honest about life, even when the facts are tough to write about. Your obligation as a memoirist is to tell your story and honor the truth.
